Wage and Overtime Law in the State of Florida

For non-exempt employees, Florida workers are entitled to the overtime compensation defined by federal law. Any time worked over 40 hours in a single week must be paid at a rate of 1.5 times the employee’s standard pay. Unlike some other states, Florida does not have its own additional laws for overtime compensation requirements. It does not require additional weekend and holiday pay by law, and any special pay rates on those dates are defined by employers.

Standard workweek wages must be paid, in full, with no exceptions. If your employer has not fully paid any of your wages, you are entitled to pursue legal action and recover your compensation and potentially additional awards, depending on your case. Specifically, Florida law states that those who win a wage violation case “shall recover the full amount of any back wages unlawfully withheld plus the same amount as liquidated damages, and shall be awarded reasonable attorney’s fees and costs. In addition, they shall be entitled to such legal or equitable relief as may be appropriate to remedy the violation including, without limitation, reinstatement in employment and/or injunctive relief.”

Employers found to be in violation of Florida’s compensation laws may also be required to pay a $1,000 fine. A member of the state legislature can also choose to enact civil litigation for the violation.
